Romanian road transport law implements EU Regulation 1071/2009 on access to the occupation of road transport operator, applying the same three mandatory conditions across all EU member states: good repute, financial standing and professional competence (CPC).

A transport licence is required before any commercial road transport operation begins

A Romanian company with a transport CAEN code (e.g. 4941 — national freight, 4942 — international freight) registered at ONRC does not automatically have the right to operate commercial road transport. An ARR transport operator licence must be obtained before the company begins any commercial transport activity. Operating without a licence results in vehicle seizure and significant fines.

Types of Road Transport Operator Licence in Romania

ARR issues transport licences for different categories of road transport. The operator must hold the specific licence for each type of transport activity it conducts. The main licence types are:

Three Mandatory Conditions for a Transport Operator Licence

EU Regulation 1071/2009 (implemented in Romanian law) requires every road transport operator to meet three mandatory conditions. Failure to meet any one of these conditions results in refusal or revocation of the licence. All three conditions must be met before the ARR application is submitted.

Condition 1 — Good Repute (Bună Reputație)

Good repute requirement What is required
Director criminal record The company’s transport manager and directors must not have been convicted of serious criminal offences — particularly offences related to road transport law, labour law, commercial law, competition law, money laundering or fiscal offences. A criminal record extract is required for all individuals.
No serious transport infringements The company (and its directors) must not have been found guilty of the most serious infringements of road transport regulations — as listed in Annex IV of EU Regulation 1071/2009 — in the preceding two years.
No regulatory disqualification The transport manager must not have been disqualified from managing transport operations by a court or regulatory authority in any EU member state.

Condition 2 — Financial Standing (Capacitate Financiară)

Financial standing requirement What is required
Minimum own funds — per vehicle The company must demonstrate sufficient financial resources to manage the transport operation properly. The minimum own funds required under EU Regulation 1071/2009 are: €9,000 for the first vehicle in the fleet + €5,000 for each additional vehicle. These amounts must be available as assets on the company’s balance sheet.
Evidence of financial standing Financial standing is demonstrated through the company’s annual financial statements (bilanț) or — for newly incorporated companies — through a bank guarantee or insurance guarantee for the required amount. ARR assesses the balance sheet or guarantee before issuing the licence.
Ongoing maintenance Financial standing must be maintained for the duration of the licence. ARR may require annual financial standing declarations. If the company’s own funds fall below the required level, the licence may be suspended.

Condition 3 — Professional Competence / CPC (Competență Profesională)

Transport Manager designation Every licensed transport operator must designate a Transport Manager (manager de transport) — an individual who holds a Certificate of Professional Competence (CPC) in road transport and who effectively and continuously manages the transport activities of the company.
CPC certificate — how to obtain The CPC is obtained by passing the written examination set by ARR (for existing holders of the Romanian CPC) or by holding a recognised CPC certificate from another EU member state. The exam covers: road transport legislation, business and financial management, technical standards and vehicle operation, road safety and international transport rules.
CPC holder can manage one company Under EU Regulation 1071/2009, a CPC holder can act as Transport Manager for a maximum of four different transport operators — with a combined fleet not exceeding 50 vehicles. Beyond these limits, the CPC holder cannot manage additional companies.
External Transport Manager If no director or employee holds a CPC, the company may appoint an external (contracted) Transport Manager. The external manager must have a genuine link to the company and must not be employed by more than four operators simultaneously.

Stage What happens

Ongoing Obligations After the Transport Licence Is Issued

Obligation Detail
Annual licence renewal ARR transport licences must be renewed annually. The renewal application must confirm that all three conditions (good repute, financial standing, CPC) continue to be met. ARR may conduct a physical inspection at renewal.
Vehicle fleet changes Adding or removing vehicles from the fleet requires notification to ARR and updated fleet documentation. Community Licence certified copies (for international operators) must be issued for each vehicle.

ARR (Autoritatea Rutieră Română) is the Romanian Road Authority — the competent authority responsible for issuing road transport operator licences, supervising road transport operators and enforcing Romanian transport law and EU transport regulations. ARR issues national and international transport operator licences for both freight and passenger transport, and is the authority that issues EU Community Licences to Romanian operators for international road transport.

However, for international operations, certified copies of the Community Licence must be present in each vehicle during operations — ARR issues one certified copy per vehicle.
